Groupon has filed a trademark and copyright infringement case against two Australian businesses that it claims use “confusingly similar terms” while providing “identical services” to the Chicago-based daily deal site.

Groupon, which said it has used its federally registered name as early as October 2008, alleges in a lawsuit filed in U.S. District Court in Chicago that two Australian corporations, Groupon Pty Ltd. And Scoopon Pty Ltd., were organized earlier this year and plan to provide or are providing identical services to the U.S. company.

One of the Australian Web sites, www.groupon.com.au, isn’t yet operating but says it’s “from the people behind Scoopon.”

The other Web site, www.scoopon.com.au, already features coupons and discounts from businesses. An email to Scoopon wasn’t immediately returned.

Groupon wants them to stop using the names.  It’s also seeking damages.
